By purchasing and downloading my digital products (the “Product”), you agree to the following Terms of Service (“TOS”):

1. Ownership & Licensing

• You are purchasing a personal-use license to use the Product within Unity-based platforms such as VRChat (or other compatible VR applications).

• You do not own the intellectual property of the Product itself and may not claim it as your own.

• The license is non-transferable, non-resellable, and non-sublicensable.

• Reselling, gifting, or transferring the Product, your account, or related access to any other person is strictly prohibited.

• All Products and associated assets (including meshes, rigging, UV mapping, and textures) remain the exclusive intellectual property of the creator.

2. Allowed Uses

You may:

• Use the Product in VRChat or compatible Unity-based VR platforms.

• Use the Product for commercial purposes (e.g., videos, streams, monetized content).

• Create private, personal edits or retextures for your own use.

• Make personal backups, as long as the original project and prefab remain intact and unmodified.

• Create NSFW edits only for private use (not to be shared, sold, or distributed without written permission).

3. Technical Requirements

• You must use the provided Unity prefab/project when uploading to VRChat.

• Do not remove or alter dummy bones, embedded metadata, or structural elements of the file.

• The integrity of the original package structure must be maintained.

4. Forbidden Uses

You may NOT:

• Share, resell, reupload, redistribute, gift, or trade the Product files, whether original, modified, or derivative.

• Send the files to another person, including editors, friends, or commission artists (they must purchase their own license).

• Use the Product or derivatives for AI training, NFT creation, or blockchain-related use.

• Use the Product as a base for creating and selling your own model, kitbash, or derivative product.

• Publicly distribute NSFW variants without written permission.

• Create derivative works intended to serve as new base models for resale or public distribution without prior approval.

5. Edits & Commissions

• You may upload a version of the Product on behalf of someone else only if they can provide proof of purchase.

• The seller reserves the right to ask for verification at any time.

• To sell variations or public derivatives, you must request and obtain written approval.

• If edits incorporate third-party assets, this must be clearly disclosed when showcasing or advertising.

6. Copyright & Legal Protection

• All Products are protected under applicable copyright law.

• Any unauthorized copying, redistribution, resale, or creation of derivative works intended to serve as a new base model is a violation of copyright law and these Terms.

• Violations may result in:

  1. Termination of your license and access to the Product.

  2. Permanent ban from future purchases.

  3. DMCA takedowns against hosting providers, platforms, and search engines.

  4. Potential civil liability, including statutory damages up to $150,000 per infringement under U.S. law (or equivalent under local jurisdiction).

7. Reporting Infringement

If you discover this Product being shared, sold, or distributed without authorization:

• Provide the full URL to the infringing material.

• Include any usernames, account links, or identifying evidence.

• Send the information to the creator through their designated support or reporting channel.

The creator reserves the right to issue DMCA takedown notices, escalate to hosting providers, and pursue legal remedies to the fullest extent permitted by law.

8. Enforcement & Escalation

• Unauthorized use or distribution may result in reporting to VRChat or related platforms under their Terms of Service.

• VRChat and similar services comply with the Digital Millennium Copyright Act (DMCA), allowing removal of infringing content.

• Continued violations may result in takedowns across hosting providers, domain registrars, and legal escalation.

9. Refunds & Enforcement

• All sales are final once the files are delivered or downloaded. No refunds will be granted.

• The creator reserves the right to revoke access, blacklist buyers, or ban future purchases for violations of these Terms.

• Buyer activity may be logged internally for anti-piracy and verification purposes.

• Usernames may be listed publicly under “violators” if breaches occur.

10. Final Terms

• These terms may be updated at any time. Major changes may require renewed agreement.

• Purchasing this Product signifies full agreement with these Terms of Service.
